1. Agreement to Terms
These Terms of Use ("Terms") are a legal agreement between you and Love & fury Inc. ("Company," "we," "us," or "our") for your use of nista. By accessing or using nista, you agree to these Terms. If you do not agree, do not use nista.
2. Service Description
nista is a Chrome extension and related service that helps users virtually try on clothes while shopping online. nista may also let you connect Gmail so nista can use read-only access to identify clothing purchase receipts and help add items you already own to your wardrobe.
Gmail connection is optional. You are responsible for deciding whether to connect Gmail and for disconnecting it if you no longer want nista to access your mailbox.
3. Accounts and Eligibility
You must provide accurate information when creating an account, joining the waitlist, or connecting third-party services. You are responsible for maintaining access to your account and for all activity under it.
4. User Content and Permissions
You may submit photos, images, product pages, wardrobe items, Gmail-derived purchase information, and other content ("User Content") to nista. You retain your rights in User Content, but you grant us a limited license to host, process, display, transform, and use User Content as needed to provide, maintain, secure, and improve nista's user-facing features.
You represent that you have the rights and permissions needed to submit User Content, including consent from any person whose image you upload.
5. Google and Gmail Integration
If you connect Gmail, you authorize nista to request read-only Gmail access and to process Gmail data as described in our Privacy Policy. nista uses Gmail data only to provide or improve visible user-facing features, including receipt detection, wardrobe creation, and purchase history.
You may disconnect Gmail in nista. Disconnecting stops future Gmail access and clears the stored refresh token, but retained wardrobe or purchase records may remain unless you request deletion.
6. Acceptable Use
You agree not to use nista to:
- violate any law or third-party right;
- upload or generate images of another person without required consent;
- create, request, or distribute illegal, exploitative, harassing, hateful, or non-consensual content;
- interfere with, reverse engineer, or abuse nista systems;
- access Gmail or other third-party accounts except through accounts you are authorized to connect.
7. Third-Party Services
nista may interoperate with third-party services, including Google, Gmail, Chrome, Tally, shopping websites, hosting providers, and AI or infrastructure providers. Your use of third-party services may be governed by their own terms and policies.
8. Beta and Availability
nista may be experimental, waitlisted, unavailable, or changed at any time. We may modify, suspend, or discontinue any part of nista without liability to you.
9. Termination
We may suspend or terminate your access to nista if you violate these Terms, create risk for other users or the service, or if we are required to do so by law. You may stop using nista at any time.
10. Disclaimers
nista is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and security.
11. Limitation of Liability
To the maximum extent permitted by law, Love & fury Inc. and its affiliates, officers, directors, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities. Our total liability for any claim relating to nista will not exceed the amount you paid us for nista in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars if you paid nothing.
12. Indemnification
You agree to defend, indemnify, and hold harmless Love & fury Inc. from claims, damages, liabilities, losses, and expenses arising from your use of nista, your User Content, your violation of these Terms, or your violation of any law or third-party right.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. You agree to the jurisdiction of state and federal courts located in Delaware for disputes that cannot be resolved informally.
14. Changes
We may update these Terms from time to time. The date at the top shows when they were last updated. Your continued use of nista after changes become effective means you accept the updated Terms.
